Everton striker Oumar Niasse has been charged with "successful deception of a match official" by the Football Association after winning a penalty in his side's 2-2 draw with Crystal Palace last weekend.
The Senegal forward is the first Premier League player to be charged under the new rule, having been accused of diving to win the penalty.
The FA said that incidents in which a referee is deceived by simulation are referred to a panel made up of an ex-match official, an ex-manager and an ex-player. If all three come to a unanimous agreement charges would be issued.
The new rule came into force in May.
